Waiver, Release, and Grant of Rights
Tasty Tours NYC LLC (“Company,” “we,” “us,” or “Tasty Tours”) operates guided food tasting and cultural walking tours (“Tours”). By booking or participating in a Tour you (“you” or the “Participant”) agree to these Terms and Conditions (the “Terms”).
1. Voluntary Participation
Participation in a Tour is voluntary. You confirm that you, as a Participant, are in good health and able to safely take part in a walking tour lasting several hours.
2. Comprehension of Risk
Tours take place in public areas that are outside of the Company’s control. You understand and accept that Tours may involve known and unknown risks, including risks which may include, but are not limited to:
- Exposure to weather conditions (heat, cold, rain, snow, or ice);
- Uneven, slippery, or broken sidewalks, curbs, or streets;
- Interactions with other pedestrians, cyclists, or motor vehicles;
- Food-related risks such as allergic reactions, foodborne illness, or choking; and
- Interactions with the public.
Participants understand that the Tours involve walking through busy public areas and accept the inherent risk of slips, trips, and falls. You agree to exercise reasonable caution at all times during a Tour.
Public Interactions
Participants acknowledge that the Tours take place in open, urban environments and that interactions with members of the public, including individuals not affiliated with the Company may occur. The Company is not responsible for the actions, behavior, or conduct of any third parties or members of the public encountered during the Tour, including harassment, offensive behavior, or other disturbances beyond the Company’s control. Participants agree to behave respectfully in accordance with applicable laws and local ordinances while participating in a Tour.
Food Allergies and Cross-Contamination
You understand that foods and beverages sampled on a Tour may contain or come into contact with common allergens, including but not limited to nuts, peanuts, dairy, eggs, gluten, wheat, soy, sesame, shellfish, and seafood.
It is each Participant’s responsibility to notify us of any dietary restrictions or allergies at the time of booking.
While we will make reasonable efforts to accommodate requests, we cannot guarantee that any food is free of allergens or cross-contamination.
Participants are responsible for carrying necessary medications (for example, an epinephrine auto-injector) and for exercising discretion when tasting.
By joining a Tour, you release and hold harmless Tasty Tours NYC LLC and our representatives from any claims or damages arising from allergic reactions or adverse health effects.
Food Safety and Preparation
We don’t prepare or handle the food served during the Tours. All food is provided by independent third-party vendors, and we make no representations regarding their food safety, preparation methods, or hygiene standards. Participants assume all risks associated with consuming food and beverages provided by such vendors, including but not limited to the risk of foodborne illness or contamination.
3. Assumption of Risk
As a Participant, you understand and voluntarily accept all risks, whether known or unknown, related to participation in a Tour, including walking, eating, or interacting in public spaces.
Some Tour stops may sell or serve alcohol independently of Tasty Tours. Any decision to purchase or consume alcohol at these venues is at your own discretion and risk. We don’t serve or supply alcoholic beverages and assume no responsibility for any consumption, intoxication, or related injury, citation, or violation of law. Participants are solely responsible for complying with all applicable alcohol laws.
4. Release of Liability and Indemnification
Each Participant, on behalf of themselves and their heirs, hereby releases and holds harmless Tasty Tours NYC LLC, its owners, employees, independent contractors (including tour guides), partners, affiliates, and insurers (collectively, the “Released Parties”) from any and all claims, losses, injuries, damages, or liabilities arising out of or relating to participation in a Tour, including those resulting from the acts or omissions of other participants, third-party vendors, or members of the public, except to the limited extent prohibited by New York law for the Company’s own gross negligence or willful misconduct.
Each Participant, on behalf of themselves, agrees to defend, indemnify, and hold harmless the Released Parties from any and all claims, demands, damages, liabilities, losses, costs, or expenses (including reasonable attorney’s fees) arising out of or connected to Participant’s conduct, negligence, or failure to follow instructions during the Tour.
5. Consent to Medical Treatment
If injury or illness occurs, you authorize us to obtain or arrange emergency medical care or transportation as deemed necessary, at your own expense. This authorization is provided for safety purposes only and does not create an obligation for us to provide or pay for such services.
6. Binding Effect
These Terms bind each Participant, their heirs, and representatives, and benefit Tasty Tours and our successors, assigns, and affiliated entities. Any waiver or release of these Terms survives a Tour and remains enforceable to the fullest extent permitted by law.
7. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full effect. Any unenforceable provision shall be modified only to the extent necessary to make it valid.
8. Promotional Release
Participants grant Tasty Tours permission to photograph, record, or film them during the Tour (“Materials”) and to use, reproduce, display, or distribute these Materials for marketing, social media, advertising, or promotional purposes, in any media now known or hereafter developed, worldwide and in perpetuity, without restriction or compensation.
We agree not to use any likeness in a way that implies endorsement of third-party products or services. Participants may request removal of identifiable photographs or videos from our active digital media by emailing
info@tastytoursnyc.com. We’ll make reasonable efforts to process requests promptly.
9. Governing Law and Venue
These Terms are governed by the laws of the State of New York, without regard to its conflicts-of-laws principles.
Any dispute shall be brought exclusively in the state or federal courts located in New York County, New York, and each Participant irrevocably agrees to the personal jurisdiction of those courts and waives any objections to venue.
To the extent permitted by law, Participants agree that claims must be brought on an individual basis and not part of a class, collective, or respective action, to the extent permitted by law.
10. Minor Participation
Parents or legal guardians booking for a minor (under the age of 18) confirm that they have read, understood, and agreed to these Terms on the minor’s behalf and accept full responsibility and liability for the minor’s participation, conduct, and safety during the Tour.
11. Weather Policy
Tours run rain or shine. We may cancel, delay, or reschedule a Tour if unsafe, extreme, or unforeseen weather or other conditions make operation of the Tour impracticable or unsafe.
If Tasty Tours cancels, you may choose to reschedule or receive a full refund to your original payment method.
If you choose not to attend while the Tour proceeds as scheduled, that booking is considered a no-show and is non-refundable.
12. Health and Communicable Diseases
You acknowledge that participation in a Tour may expose you to communicable diseases or illnesses (including COVID-19 and similar public-health risks) and you voluntarily assume all such risks. Each Participants releases and holds harmless Tasty Tours and the Released Parties from any claims or losses related to exposure or infection, except where prohibited by New York Law.
13. Booking, Refunds, and Cancellations
All bookings are final once confirmed. Tickets are valid only for the date and time purchased unless we approve a change in writing.
Public Food Tours
- Cancellations made more than 24 hours before the scheduled start time are eligible for a full refund.
- Cancellations made within 24 hours of the start time or no-shows are non-refundable.
Private Food Tours
- Cancellations made more than 72 hours before the scheduled start time are eligible for a refund minus the $100 deposit.
- Cancellations within 72 hours of the start time or no-shows are non-refundable.
If booked through a third-party platform (such as Viator, GetYourGuide, Airbnb Experiences, Groupon, Project Expedition, or Course Horse), that platform’s cancellation policy will apply and may take precedence over these Terms.
Tasty Tours reserves the right to modify, reschedule, or cancel a Tour due to unforeseen circumstances such as restaurant closures, staff illness, transportation interruptions, or safety concerns. In such cases, Participants may reschedule or receive a full refund to the original payment method at the Company’s discretion.
We may also cancel or reschedule a Tour if the minimum required number of Participants is not met; in such cases, all Participants for that Tour will be offered alternative dates or a full refund.
14. Late Arrivals and No-Shows
Tours begin promptly at the listed start time. Participants who arrive late may not be able to join once the group has departed.
Refunds or reschedules are not available for late arrivals or no-shows. Please plan adequate travel time and contact us if you expect to be late; we’ll try to help but can’t guarantee accommodation once the Tour has started.
15. Accessibility and Physical Requirements
Participants should be able to walk at a moderate pace for up to three (3) hours and navigate public sidewalks, uneven terrain, and stairs.
We will make reasonable efforts to accommodate mobility concerns or accessibility requests if notified at least forty-eight (48) hours in advance, though some venues and locations may not be fully accessible.
16. Personal Property
Participants are solely responsible for their personal belongings and valuables during the Tour. The Company and Released Parties do not assume any responsibility or liability for loss, theft, or damage to personal property, including during visits to third-party venues or restaurants.
Participants are encouraged to carry only essential items and to keep your belongings with you at all times.
17. Conduct
We reserve the right to remove any Participant whose behavior is unsafe, disruptive, disrespectful, or otherwise interferes with the enjoyment or safety of others. You must follow your guide’s instructions and comply with local laws, including those on alcohol use and public conduct.
We aren’t responsible for disruptions or disturbances caused by members of the public, nearby businesses, or other third parties. No refund will be provided in such cases.
18. Third-Party Vendors
Tours include visits to restaurants and establishments that are independently owned and operated. Tasty Tours is not responsible for the acts, omissions, or negligence of any third-party vendors or venues.
Each Participant acknowledges that all food and beverages are provided by independent vendors and that we make no warranties or guarantees about their food safety, preparation, or hygiene standards.
19. Applicability to Third-Party Bookings
These Terms apply to all bookings and Participants, regardless of the platform or method used to make a reservation, including but not limited to Viator, TripAdvisor, GetYourGuide, Airbnb Experiences, or any other third-party website or booking service.
By booking through any such platform, you agree that participation in a Tour constitutes acceptance of these Terms, which are publicly available at:

By purchasing, reserving, or participating in a Tour, each Participant acknowledges and agrees to be bound by these Terms and releases Tasty Tours and its representatives, including independent contractors and tour guides, from any and all claims as set forth herein.
20. Non-Transferable Tickets
Tour tickets are personal to the Participant and are non-transferable. They may not be resold, reassigned, or used by anyone other than the original purchaser without our written consent. We may refuse service to anyone not listed on the booking or using an unauthorized ticket.
21. Limitation of Liability
To the maximum extent permitted by law, in no event shall Tasty Tours’ total liability arising out of or in connection with any Tour exceed the total amount paid by the participant for that Tour. The Company shall not be liable for any indirect, incidental, or consequential damages of any kind.
22. Force Majeure
We aren’t liable for any failure or delay in performing our obligations, including the running of any Tour, when such failure or delay results from circumstances beyond our reasonable control. These include, without limitation, acts of God, severe weather, government restrictions, natural disasters, labor disputes, public health emergencies, transportation disruptions, or any other event that makes operation of the Tour impracticable or unsafe. In such cases, we may modify, reschedule, or cancel the Tour without liability and, at its discretion, offer Participants a rescheduled date or refund.
23. Language
These Terms are written in English, which shall control in the event of any inconsistency with a translated version.
24. Updates of The Terms
We may update these Terms occasionally to reflect changes in our business or applicable law. The latest version will always appear on our website with its effective date. Booking or joining a tour after an update means you accept the updated Terms.
25. Electronic Signature and Agreement
By purchasing a ticket, completing an online booking, or joining a Tour, each Participant confirms that they have read, understood, and agree to these Terms. Checking a box, submitting a booking form, or otherwise indicating agreement online constitutes a legally binding electronic signature.
Acknowledgment:
By joining a Tasty Tours NYC LLC event, I confirm that I have read and understood these Terms and Conditions and voluntarily agree to them.
Effective Date: October 30, 2025
These Terms and Conditions supersede all prior versions and remain in effect until updated by Tasty Tours NYC LLC.
